I. Practice and Experience:
ADMITTED IN THE FOLLOWING COURTS:
Admitted as an attorney in the States of New York (since 1999) and New Jersey (1998), in the Federal District Court for the Eastern District of the State of New York and the Southern District of the State of New York.
II. Areas of Practice:
My practice is dedicated to Immigration and Nationality Law. I have appeared in hearings before Immigration Courts in several states, including New York, New Jersey, Connecticut, Pennsylvania, Maryland, Florida, Texas, Ohio, New Hampshire and Hawaii. The Law Firm of Youman, Madeo & Fasano, LLP, of which I am a partner, has represented tens of thousands of people in immigration courts and federal courts in several Districts and Circuits of the United States.
I was also the Legal Counsel for the General Consulate of Bolivia in New York during the years 1998-2000.
III. Cases of Interest:
Below is a list of cases, among others, in which I was the Lawyer of Record:
In Candia Rolando v. NYC Taxi & Limousine Commission, 100677-2000 (the decision in this case was in favor of my client, who was a taxi driver in the city of New York; his "Hack" license was taken away because he tested positive for cocaine in his blood. But the judge was in agreement with us that the reason for his positive test was that, as he was Bolivian, he drank the tea "mate de coca" every day, and as such, he was not a consumer of cocaine); Matter of ILIC, 25 I & N Dec. 717 (BIA 2012) (this case has become precedent, as it holds that derivative beneficiaries in family petitions need not prove physical presence in the United States on December 21, 2000); Matter of Walter Nugra BIA (case not yet published ) (in this case the BIA (Board of Immigration Appeals) ruled that the hardship of a non U.S. citizen or permanent resident child of the applicant in a Cancellation of Removal case, is also part of the hardship suffered by the brother or sister of the child who is a United States citizen).
IV. Professional Activities:
I am the Producer and Host of the weekly TV program "Hablando de Inmigraicion con el Abogado Rodney Youman," which is aired by the following TV channels: Unimas, Univision, Telemundo, Azteca America and Ecuavisa. In the program, we have shown interviews I have conducted with Mayors from Latin American cities, United States Consuls of several Latin American countries, world famous Latin-American artists and singers and with Presidents, including an exclusive interview with the President of Uruguay, José Mujica, at the Presidential Palace in Montevideo, Uruguay. Furthermore, together with my partners, H. Raymond Fasano, Esq. and Donald Madeo, Esq., we present segments dedicated to legal advice on the issues of immigration to hundreds of thousands of television viewers. In addition, I present a segment and I am the executive producer of the program "Que Tal America" which appears weekly on the Spanish television channel Azteca America.
Furthermore, beforehand and during the last decade, I have provided immigration legal segments in the programs “Asi es Ecuador”, "Soy Ecuador" and "593 Ecuador". I have also appeared on shows like "Al Rojo Vivo" on Telemundo, in which I was interviewed regarding my legal opinion in a high profile case in the United States.
My interviews have also been published in newspapers such as "Ecuador News".
I also speak at Conferences on Immigration organized by several entities and civic committees in the Tri-State Area.
V. Dedication to the Immigration Laws:
I feel a real passion for my work. This is because the field of Immigration in America is one that affects millions of lives and families. Real professional satisfaction occurs when a customer has the opportunity to return to his or her home country for the first time in many years, or when a family is reunited after a long time. It is also total satisfaction and a very moving experience when we win a case in the immigration courts; and when we avoid the deportation of an individual and we know that that person will be able to remain in the United States with his family.
