Same sex marriage sponsorship

DHS FAQs on the effect of the Supreme Court's ruling that Section 3 of DOMA is unconstitutional. USCs and LPRs in same-sex marriages can now sponsor their spouses for immigrant visas. In evaluating the petition, USCIS will generally look to the law of the place where the marriage took place.

And on this topic, it is important to note that the Supreme Court ruling and the USCIS decision to fully acknowledge same sex marriages will have implications beyond simple spousal petitions. This will also assist same sex spouses seeking derivative benefits such as in employment based petitions and asylum petitions. It will also enable an abused spouse in a same sex marriage to seek relief under the VAWA provisions.
